The state of New York requires vehicles to have certain auto insurance coverage before they can be registered and license plates can be issued, and insurers are required to report the status of all policies as a way to track down uninsured vehicles. Penalties for having an uninsured vehicle can include the suspension of a vehicle registration or drivers license along with penalty fees.
New York auto insurance law requires the following coverage as a minimum:
Liability CoverageProtects against any bodily injury or property damage the policyholder is liable for as a result of an automobile accident. The limits required by the state of New York are:
$25,000 for bodily injury coverage per person, or $50,000 for any death, as a result of injury sustained in an automobile accident
$50,000 for bodily injury coverage for multiple people, or $100,000 total coverage as a result of multiple deaths
$10,000 coverage for damage to any vehicle or property
Personal Injury Protection-
Pays medical expenses and loss of wages for injuries that are the result of a vehicle accident, regardless of fault. This coverage does not provide protection for the insured vehicle's own damages.
$50,000 bodily injury coverage per person in the policyholder's vehicle, including the driver and passengers, as well as pedestrians injured by the insured vehicle
There are exclusions to this coverage under a few circumstances. This coverage will not provide apply if a person:
  • Is injured as a result of committing a felony or crime
  • Is driving under the influence of drugs or alcohol
  • Receives intentional, self-inflicted injuries
  • Is injured while operating, or as a pedestrian involved in an accident with a motorcycle or ATV
Uninsured MotoristsProtects policyholders and their family or passengers for bodily injury as a result of an accident occurring in New York state in which the person at fault was uninsured or a hit-and-run accident. Uninsured motorist coverage does not provide any protection for the insured vehicle's own damages.
The limits of uninsured motorist coverage usually are equal to the limits of liability.
  • $25,000 for bodily injury per person
  • $50,000 total for bodily injury per accident
  • $50,000 per person in case of death
  • $100,000 total for multiple deaths
